Legal Protections for Religious Beliefs in the Workplace
New York State and New York City protect employees’ religious rights. The New York State Human Rights Law (NYSHRL) and the New York City Human Rights Law (NYCHRL) require employers to provide reasonable religious accommodations. They must do so unless it causes undue hardship to the business.
Title VII of the Civil Rights Act of 1964, a federal law, also protects employees. Employers cannot refuse to hire, fire, or mistreat workers because of their religion.
What Is a Religious Accommodation?
A religious accommodation is any workplace adjustment that allows employees to practice their faith. This can include:
- Flexible scheduling: Time off for Sabbath or prayer breaks
- Religious attire: Hijabs, kippahs, turbans, or religious symbols
- Workplace policy changes: Allowing beards despite grooming rules
- Prayer spaces: Providing a room for prayer or meditation
Employers must provide these accommodations unless they prove it creates a serious hardship.
Identifying Religious Discrimination in the Workplace
Not all employers follow the law. Religious discrimination still happens. Signs that your rights may be violated include:
- Denial of accommodations: Your employer refuses your request without a valid reason
- Harassment: Coworkers or managers make offensive remarks or create a hostile work environment
- Unequal treatment: Your employer denies promotions, demotes you, or assigns you worse tasks due to religion
- Retaliation: Your employer punishes you for requesting religious accommodations. This could include firing, demotion, or negative performance reviews
Steps to Take If Your Rights Are Violated
If you think your employer violated your rights, take action:
- Report the issue: Talk to your HR department or supervisor.
- Seek legal help: Consult an employment attorney if your employer refuses to comply or retaliates against you. We recommend talking to an employment attorney before taking any further steps.
- File a complaint: Report the violation to the New York State Division of Human Rights (NYSDHR), the New York City Commission on Human Rights (NYCCHR), or the Equal Employment Opportunity Commission (EEOC).
