New Collective Action filed vs. A & J Iron Works, Inc., et al.

Jaime Vintimilla v. A & J Iron Works, Inc., and Rene Hernandez, Case No. 15-cv-2691

On May 11, 2015, Lead Plaintiff Jaime Vintimilla on behalf of himself and those similarly situated filed a class and collective action lawsuit in United States District Court – Eastern District of New York vs. A & J Iron Works, Inc. and its owner Rene Hernandez. Mr. Vintimilla worked for Defendant, a company that crafts decorative and structural iron and steel works as an employee from in or about 2002 through March 30, 2015. He alleges that he worked around fifty-five hours per week throughout his employment. However, Defendants failed to pay Mr. Vintimilla the proper minimum wage, or at any rate of pay, or the proper overtime compensation at the statutorily-required overtime rate of pay for any hour that he worked per week over forty hours per week, or as the New York Labor Law, New York Compensation Codes Rules and Regulations, and the Federal Fair Labor Standards Act require. Furthermore, Defendants failed to pay Mr. Vintimilla at his regular rate of pay for each hour that he worked in accordance with his terms of employment. In addition, Defendants failed to furnish Mr. Vintimilla with accurate wage statements on each payday as required by the New York Labor Law.
