On January 21, 2015, Lead Plaintiff Maria Henriquez on behalf of herself and those similarly situated filed a class and collective action lawsuit in United States District Court – Eastern District of New York vs. 811 Elmont Road General Merchandise, Inc., and Abdul Hameed. Ms. Henriquez worked for Defendants, a dollar store which does business as “99 Cent Time,” providing floor help in the store from June 2006 through the present. She alleges that she works fifty-one hours per week through her employment. However, Defendants fail to pay Ms. Henriquez the proper minimum wage, at any rate of pay or the proper overtime compensation at the statutorily-required overtime rate of pay for any hour that she worked over forty hours per week as the New York Labor Law, New York Compensation Codes Rules and Regulations, and the Federal Fair Labor Standards Act require. In addition, Defendants fail to furnish Ms. Henriquez with accurate wage statements on each payday, or with proper wage notices on an annual basis as required by the New York Labor Law.
Making matters signfiicantly worse, Ms. Henriquez alleges that Defendant Hameed subjects her to egregrious and relentless gender discrimination in the form of hostile work environment sexual harassment. Ms. Henriquez alleges that on a nearly daily basis, Defendant Hameed propositions her for sex, fondles her breasts, and forces her to wear a skirt while she is working.
