New Collective Action filed vs. 45-53 West 110 Street Housing Development Fund Corporation, et al.

Edwin Colon v. 45-53 West 110 Street Housing Development Fund Corporation, All Area Realty Services, Inc., Ernedis Jesus Gertuche, Kalitchi Figueroa, and Glenna Meeks, Case No. 15-cv-2050

On April 30, 2015, Lead Plaintiff Edwin Colon on behalf of himself and those similarly situated filed a class and collective action lawsuit in United States District Court – Southern District of New York vs. 45-53 West 110 Street Housing Development Fund Corporation, All Area Realty Services, Inc., Ernedis Jesus Gertuche, Kalitchi Figueroa, and Glenna Meeks. Mr. Colon worked for Defendants, a cooperative apartment building and its board of directors, as a resident superintendent from February 2006 through August 18, 2014. He alleges that he worked at least ten hours of physical labor in addition to his regularly scheduled forty hour work week, and was required to be on call twenty-four hours a day, seven days a week throughout his employment. However, Defendants failed to pay Mr. Colon the proper minimum wage, at any rate of pay, or the proper overtime compensation at the statutorily-required overtime rate of pay for any hour that he worked per week over forty hours per week as the Federal Fair Labor Standards Act requires. Defendants also failed to furnish Mr. Colon with proper wage statements on any occasion that they paid him wages as required by the New York Labor Law. Making matters worse, Defendants slandered and made libelous statements about Mr. Colon.
