Miguel Palacios v. Blue Star Meat Corp., et al., Case No. 14-cv-7765

On September 25, 2014, Lead Plaintiff Miguel Palacios on behalf of himself and those similarly situated filed a class and collective action lawsuit in United States District Court – Southern District of New York vs. Blue Star Meat Corp. and individuals Bok Cheon, Dina Cheon, and Sang Hyun Lee. Mr. Palacios worked for Defendants as a truck driver from in or around August 2008 until in or around March 2013. Mr. Palacios alleges that he often worked between forty-five and forty-six hours per week, but Defendants failed to pay him overtime compensation at the statutorily-required overtime rate of pay for each hour that he worked per week that was in excess of forty total hours, as the New York Labor Law, New York Compensation Codes Rules and Regulations, and the Federal Fair Labor Standards Act require. In addition, Defendants failed to furnish Mr. Palacios with accurate wage statements on each payday as required by the New York Labor Law.
