On November 18, 2014, Lead Plaintiff Matthew Mendez on behalf of himself and those similarly situated filed a collective action lawsuit in United States District Court – Eastern District of New York vs. Enecon Northeast Applied Polymer Systems, Inc., and Robert Barr and Michael Barr. Mr. Mendez worked as a technician for Defendants from October 2013 through July 2014. He alleges that he was required to report to the company’s home base between the hours of 5:00 A.M. and 6:00 A.M. to load the company vehicle, then report to his job site between the hours of 6:00 A.M. and 7:00 A.M, and after working at the job site, he was required to return back to the company’s home back between the hours of 4:00 P.M. and 5:00 P.M. Therefore, Mr. Mendez worked between forty-five to sixty hours per week, but Defendants failed to pay Mr. Mendez minimum wage for the hours he worked, any rate of pay for his travel time to and from the job sites, and overtime compensation at the statutorily-required overtime rate of pay for each hour that he worked per week that was in excess of forty total hours, as the New York Labor Law, New York Compensation Codes Rules and Regulations, and the Federal Fair Labor Standards Act require. In addition, Defendants failed to furnish Mr. Mendez with accurate wage statements on each payday as required by the New York Labor Law.
