On January 19, 2015, Lead Plaintiff Maria Portillo on behalf of herself and those similarly situated filed a collective action lawsuit in United States District Court – Eastern District of New York vs. ESH Laboratory Inc. and Elizabeth Salcedo. Ms. Portillo worked as a non-managerial employee who physically assembled the orthopedic shoes that Defendant sold to their customers from January 2009 through February 2014. She alleges that she routinely worked forty hours per week. However, Defendants failed to pay Ms. Portillo at any rate of pay or the proper overtime compensation at the statutorily-required overtime rate of pay for any hour that she worked per week over forty hours per week as the New York Labor Law, New York Compensation Codes Rules and Regulations, and the Federal Fair Labor Standards Act require. In addition, Defendants failed to furnish Ms. Portillo with accurate wage statements on each payday as required by the New York Labor Law.
