New Collective Action filed vs. B&M General Renovation, Inc. d/b/a B&M General Renovation, et al.
Rafael Morales v. B&M General Renovation, Inc. d/b/a B&M General Renovation, Michael Luong, and Theresa Luong, Case No. 14-cv-07290

On December 15, 2014, Lead Plaintiff Rafael Morales on behalf of himself and those similarly situated filed a class and collective action lawsuit in United States District Court – Eastern District of New York vs. B&M General Renovation, Inc. d/b/a B&M General Renovation, Michael Luong, and Theresa Luong. Mr. Colon worked as a laborer for Defendants from March 2013 through December 2013. He alleges that he worked at least fifty-seven hours per week. However, Defendants failed to pay Mr. Morales any rate of pay or the proper overtime compensation at the statutorily-required overtime rate of pay for any hour that he worked per week over forty hours per week as the New York Labor Law, New York Compensation Codes Rules and Regulations, and the Federal Fair Labor Standards Act require. In addition, Defendants failed to furnish Mr. Morales with accurate wage statements on each payday as required by the New York Labor Law.
