On March 21, 2017 Lead Plaintiffs Zenith Dey and Libby Abesamis on behalf of themselves and those similarly situated filed a class and collective action lawsuit in United States District Court – Southern District of New York against Next Cleaners NY1, LLC, and Next Cleaners, LLC, and Next At 808 Columbus Inc., and Kam Saifi, individually, and George Inakavadze, individually, and Alekey Berezov, individually (“Defendants”). Defendants operate a chain of approximately twenty laundromats/dry cleaners throughout New York City and New Jersey. Plaintiffs worked for Defendants as bicycle delivery drivers and store clerks from July 2014 to March 2017. Plaintiffs allege that they worked beyond forty hours in a work week throughout their employment. However, Defendants failed to pay them for any hours worked after forty at any rate of pay for any hour that they worked per week over forty hours as the New York Labor Law and the Federal Fair Labor Standards Act require. In addition, Defendants failed to furnish Plaintiffs with accurate wage statements on each payday, as required by the New York Labor Law.
