On March 7, 2017 Shirley Guzman-Reina, on behalf of herself, individually, and on behalf of all others similarly-situated, filed a class and collective action lawsuit in United States District Court – Eastern District of New York vs. ABCO Maintenance, Inc. Mr. Guzman-Reina worked at ABCO Maintenance, Inc., as a dispatcher and her main duties consisted of communicating and coordinating with Defendants’ laborers about daily tasks that had to be completed. The complaint alleges that throughout her employment which began in September 2013, Ms. Guzman-Reina regularly worked between forty-five and fifty hours per week. However, the defendant failed to compensate Ms. Guzman-Reina at an overtime rate for all hours worked over forty as required by the New York Labor Law, New York Compensation Codes Rules and Regulations, and the Federal Fair Labor Standards Act.
