Erasmo Cruz v. Mercury Construction Concepts, Inc., et al. Case No. 17-cv-00153

On January 9, 2017, Erasmo Cruz on behalf of himself, individually, and on behalf of all others similarly-situated, filed a class and collective action lawsuit in United States District Court – Southern District of New York vs Mercury Construction Concepts and its owner Andrew Russac. Mr. Russac employed Mr. Cruz as a laborer from May 2007 to September 2016 and Mr. Cruz’s duties consisted of laying cement, installing kitchen and bathroom cabinets, laying tile, painting rooms, hanging sheetrock, carrying materials and tools, and keeping areas clean. The complaint alleges that although Mr. Cruz often worked 50 or 60 hours per week throughout his employment, defendant Russac failed to pay Mr. Cruz a regular hourly wage, failed to pay Mr. Cruz an adequate overtime rate of pay for additional hours he worked per week over 40, and failed to provide wage statements to Cruz. This as was all in violation of the Fair Labor Standards Act and the New York Labor Law.
