Yushwant Roopnarine v. Modell Collateral Loans Inc. et al. Case No. 16-cv-05822

On October 18, 2016 Yushwant Roopnarine, on behalf of himself, individually, and on behalf of all others similarly-situated, filed a class and collective action lawsuit in United States District Court – Eastern District of New York vs. Modell Collateral Loans Inc. Mr. Roopnarine worked at Modell Collateral Loans and handled a variety of tasks including cleaning the store, wiping the windows, sweeping and mopping the floor, cleaning the bathrooms, and taking out trash. The complaint alleges that throughout his employment from August 2011 to August 2016 Mr. Roopnarine regularly worked 47 hours per week. However the defendant failed to pay him any rate of pay for hours worked over 40, let alone at the overtime rate required by the New York Labor Law, New York Compensation Codes Rules and Regulations, and the Federal Fair Labor Standards Act. Additionally, when Mr. Roopnarine was diagnosed with clinical depression the defendant treated the diagnosis with disdain and rather than work with Mr. Roopnarine, dismissed him outright.
