Fortino Callejas v. 427 Kings Highway, Inc. d/b/a Peppino’s Brick Oven Pizza & Restaurant and Joseph Mancino, Case No. 14-cv-06628
On November 11, 2014, Lead Plaintiff Fortino Callejas on behalf of himself and those similarly situated filed a class and collective action lawsuit in United States District Court – Eastern District of New York vs. 427 Kings Highway, Inc. d/b/a Peppino’s Brick Oven Pizza & Restaurant and Joseph Mancino. Mr. Callejas worked for Defendants as a cook from January 2011 through September 2014. He alleges that he worked about six days a week in shifts of ten-and-one half hours to thirteen hours per day for approximately sixty-three to seventy-eight hours per week. However, Defendants failed to pay Mr. Callejas overtime compensation at the statutorily-required overtime rate of pay for each hour that he worked per week that was in excess of forty total hours, as the New York Labor Law, New York Compensation Codes Rules and Regulations, and the Federal Fair Labor Standards Act require. In addition, Defendants failed to furnish Mr. Callejas with accurate wage statements on each payday as required by the New York Labor Law.
