Sidy Diawara v. XPO Logistics Worldwide, Inc. and Ralph Wheaty Case No: 1:16-cv-03443
On May 9, 2016 Lead Plaintiff Sidy Diawara on behalf of himself and those similarly situated filed a class and collective action lawsuit in United States District Court – Southern District of New York vs. XPO Logistics Worldwide, Inc., f/k/a UX Specialized Logistics, LLC and Contractor Management Services, L.L.C. and Ralph Wheaty. As the complaint alleges, Mr. Diawara worked for Defendants, a provider of supply chain services for customers worldwide, as a delivery driver. Plaintiff worked for Defendants as a driver with duties that required him to travel around New York from April 12, 2004 through January 6, 2014. Plaintiff worked in excess of forty hours each week. However, Defendants failed to compensate Plaintiff for any hours worked after forty at any rate of pay or the proper overtime compensation at the statutorily-required overtime rate of pay for any hour that he worked per week over forty hours as the New York Labor Law and the Federal Fair Labor Standards Act require. In addition, Defendants failed to furnish Mr. Diawara with accurate wage statements on each payday as required by the New York Labor Law.
