New Collective Action filed in the Eastern District of New York
Alejandro Hernandez and Victor Guzman v. OMG Taco Corp. II, Mohamed Alhidami and Sam Kaplan, Case No: 1:16-cv-02262 (NGG) (JO).
On May 5, 2016 Lead Plaintiffs Alejandro Hernandez and Victor Guzman on behalf of themselves and those similarly situated filed a class and collective action lawsuit in United States District Court – Eastern District of New York vs. OMG Taco Corp. II, Mohamed Alhidami and Sam Kaplan. As the complaint alleges, Mr. Hernandez and Mr. Guzman worked for Defendants, a Mexican Restaurant. Plaintiffs worked for Defendants from April 14, 2013 to October 14, 2015. Plaintiffs allege that they worked at least fifty-four hours per week throughout their employment. However, Defendants failed to pay Plaintiffs for any hours worked after forty at any rate of pay or the proper overtime compensation at the statutorily-required overtime rate of pay for any hour that they worked per week over forty hours as the New York Labor Law and the Federal Fair Labor Standards Act require. In addition, Defendants failed to furnish Plaintiffs with accurate wage statements on each payday, as required by the New York Labor Law.
