Altaf Chowdhury v. Peter Luger, Inc., et al., Case No. 14-cv-5880

On October 7, 2014, Lead Plaintiff Altaf Chowdhury on behalf of himself and those similarly situated filed a class and collective action lawsuit in United States District Court – Eastern District of New York vs. Peter Luger, Inc., Peter Luger of Long Island, Inc., and individuals Amy Rubenstein, Marilyn Spiera and Costa Arama. Mr. Chowdhury began working for Defendants as a server in or around September 2011. Throughout his employment, Mr. Chowdhury has routinely worked over forty hours per week, but Defendants failed to pay him overtime compensation at the statutorily-required overtime rate of pay for each hour that he worked per week that was in excess of forty total hours, as the New York Labor Law, New York Compensation Codes Rules and Regulations, and the Federal Fair Labor Standards Act require. In addition, Defendants failed to furnish Mr. Chowdhury with accurate wage statements on each payday as required by the New York Labor Law.
